Terms of Service
These Terms govern your use of the Xiaoxiaodong Member Site. Our content is licensed for genuine personal creation—not for copying the library, resale, model training, commercial exploitation, or building a competing product.
01Scope and contracting party
These Terms apply when you visit or use xiaoxiaodong.ai, www.xiaoxiaodong.ai, vip.xiaoxiaodong.ai, and the prompt library, open content, articles, image-generation tools, membership, notices, and related features made available through those domains (collectively, the “Service”).
“We,” “us,” or the “Operator” means the actual operator of the Xiaoxiaodong Member Site, as identified in payment pages, order information, or legally required website disclosures. “You” means any visitor, registered user, purchaser, or person using the Service.
Registration, purchase, submission of content, or use of member features constitutes acceptance of these Terms, the Privacy Policy, and the AIGC Acceptable Use Policy. Nothing in these Terms excludes mandatory consumer rights or other rights that cannot lawfully be waived.
This English version is provided for accessibility. If it conflicts with the Chinese version, the Chinese version controls to the extent permitted by applicable law. Mandatory rights under applicable law remain unaffected.
02Eligibility and accounts
- You must have the legal capacity required for your use. Users under 18 should use the Service only with a guardian’s review and consent. The Service is not intentionally directed to children under 14.
- You may register with email and password or a supported third-party sign-in method. Information you provide must be accurate, current, and lawfully provided.
- An account is personal to its registered user. Unless we expressly approve a team plan in writing, you may not rent, lend, sell, transfer, gift, share, or rotate use of an account.
- You are responsible for safeguarding passwords, sessions, verification codes, third-party credentials, and API keys. Promptly secure your account and contact us if you suspect unauthorized use.
- You may not create accounts in bulk, operate account farms, impersonate others, bypass registration controls, or use temporary email or automation for fraud or evasion.
03The Service and changes
The Service may include prompt search and detail views, open-source content, favorites and ratings, articles and newsletters, paid memberships and redemption codes, an image-generation workspace, user-configured image APIs, generation history, and future features.
Prompts, samples, categories, rankings, tools, quantities, and third-party integrations change over time. Displayed counts, roadmaps, or update goals are not promises of a permanent quantity or release schedule. We may add, modify, suspend, or discontinue features for product, quality, compliance, security, cost, or provider reasons.
If a change materially reduces a paid user’s core benefit during the remaining membership term, we will provide reasonable notice and, where required, an appropriate remedy such as continued performance, a substitute, an extension, or a refund.
04Membership, payment, and refunds
- Price and term: the currency, price, duration, and benefits shown when you submit an order control.
- Activation: membership normally activates after payment confirmation or successful code redemption. Keep the order number and contact support if activation is delayed; do not pay twice.
- No automatic renewal by default: we will not automatically charge a renewal unless a purchase page clearly offers it and you separately authorize it.
- Digital performance: access normally begins immediately after payment. Refund eligibility is assessed under the actual performance, reason for the request, usage, purchase-page commitments, payment-channel rules, and applicable law; access to digital content does not automatically eliminate mandatory refund rights.
- Payment providers: WeChat Pay, Alipay, and other providers independently process payment. We generally receive transaction identifiers, amounts, status, and reconciliation data, not full card numbers or payment passwords.
- Promotions and codes: redemption codes, discounts, and gifted benefits may not be resold, cashed out, or used fraudulently.
05Intellectual property and content license
5.1 Our content
Unless expressly stated otherwise, prompts and their arrangement, style names and descriptions, tags, search and recommendation structures, sample images, articles, database collections, interfaces, visual design, software, trademarks, and branding (collectively, “Site Content”) are owned by us or the relevant rights holders.
5.2 Limited personal license
During an active membership, we grant you a revocable, limited, non-exclusive, non-transferable, and non-sublicensable right to access and use Site Content solely for your own normal learning, search, testing, and non-commercial creation. A membership fee purchases time-limited access, not ownership of Site Content, a database, or intellectual property.
5.3 Commercial-use boundary
You may not sell, resell, rent, publish, distribute for payment, download for others, sublicense, package, deliver, or otherwise monetize Site Content or a substantially substitutable version. You may not turn it into a course, resource pack, community benefit, paid database, API, plugin, bot, directory, or competing product.
You may use a small number of individual prompts as tools in your own non-commercial workflow. Any direct or indirect revenue-generating use—including client deliverables, advertising, marketing, paid content, e-commerce, paid services, monetized accounts, or internal business production—requires our prior express written commercial authorization. Even when authorized, outputs must not expose recoverable prompts or bulk-extractable Site Content, and you may not imply our endorsement. A specific license or open-source license displayed with an item overrides this general rule for that item.
5.4 Reserved rights
All rights not expressly granted are reserved. Removing a watermark, copyright notice, access control, or rights-management information does not place content in the public domain.
06No scraping, extraction, or model training
Except for ordinary search-engine indexing of public pages in accordance with robots directives or our prior written authorization, you may not directly, indirectly, or through another person:
- use crawlers, spiders, scripts, headless browsers, RPA, browser extensions, packet capture, simulated clicks, batch screenshots, OCR, API polling, or other automation to access, search, copy, download, or monitor Site Content;
- download all or a substantial quantity of prompts, images, metadata, tags, articles, or search results, or systematically enumerate URLs, object paths, content IDs, or API parameters;
- bypass login, membership checks, rate limits, challenges, quotas, permissions, signatures, cache controls, robots rules, or other technical safeguards;
- evade controls through multiple accounts, shared credentials, proxy IPs, device pools, distributed requests, or long-running low-rate extraction;
- build a mirror, cache, offline library, vector database, retrieval-augmented generation (RAG) knowledge base, prompt search engine, or substitute collection;
- use Site Content to train, fine-tune, distill, evaluate, benchmark, generate synthetic data for, or improve a machine-learning or artificial-intelligence model, or to infer prompts, system instructions, classifications, or recommendation logic; or
- provide scraping, lookup, bulk-download, circumvention, or extraction services, tools, accounts, links, or data to another person.
We may use rate limits, challenges, access logs, account and device signals, content fingerprints, watermarks, decoy records, and other lawful safeguards to detect and stop abuse.
07Acceptable use
You may not use the Service to create, upload, generate, distribute, or facilitate illegal content; terrorism or violent extremism; child sexual exploitation; non-consensual intimate imagery; severe violence or self-harm encouragement; hate or unlawful discrimination; fraud, phishing, malware, spam, or unauthorized intrusion; infringement of intellectual property, privacy, publicity, reputation, personal information, or trade secrets; deceptive deepfakes, impersonation, or fabricated evidence; interference with the Service; or abusive consumption of compute, bandwidth, storage, or provider quotas.
The complete prohibited-content rules, reporting channels, content-moderation process, enforcement measures, notices, and appeals are set out in the AIGC Acceptable Use Policy, which forms part of these Terms.
08Image generation, inputs, and outputs
- Your inputs: you retain rights you lawfully hold in your prompts, reference images, and other inputs, and grant us only the processing rights reasonably necessary to provide, protect, and improve the Service. You represent that you may lawfully submit them.
- Third-party models: generation may use a provider you select or configure. Prompts, reference images, and necessary parameters are sent to that provider and remain subject to its terms, privacy practices, content rules, pricing, and availability.
- API keys: a user-configured key is used only to connect to the selected provider as instructed. You are responsible for the key’s lawful source, scope, security, and provider charges.
- Outputs: subject to law, provider terms, and the Site Content license, you may claim rights available in your own outputs. We do not acquire ownership merely by providing the technical channel, but underlying Site Content and third-party rights do not transfer to you.
- No guarantee of uniqueness or commercial suitability: outputs may be similar to others and may contain errors, bias, or third-party elements. We do not guarantee originality, uniqueness, accuracy, non-infringement, or fitness for commercial use. Review outputs and obtain necessary permissions before publication, commercial use, or important decisions.
- History: if you save generation history, prompts, task settings, references, and outputs may be stored in your account space until deleted or otherwise retained under the Privacy Policy.
09Third-party services and links
The Service may rely on or link to Cloudflare, Google, WeChat Pay, Alipay, email services, image-model or API providers, Zhishixingqiu, GitHub, and other independent services. We do not control their content, rules, fees, data processing, or continued availability. Review the destination and its terms before leaving the Service or transacting.
10Risk controls, breach, and remedies
If we reasonably believe an account presents security, fraud, sharing, scraping, abusive-compute, infringement, or other Terms risk, we may issue a warning, rate-limit, request verification, restrict functions, suspend or terminate an account or membership, remove unlawful content, prevent re-registration, preserve evidence, or report to a competent authority. Urgent safety actions may occur before notice.
Except where necessary to stop ongoing abuse or where law requires otherwise, we will try to provide a reason and an appeal opportunity. You remain legally responsible for losses caused by your breach, including reasonable investigation and enforcement costs recoverable under applicable law.
11Intellectual-property and rights complaints
A rights complaint should identify the claimant, contact details, proof of rights, the exact URL or location, the basis of the complaint, requested action, and a statement that the submission is accurate. We may request additional verification, notify the affected user, preserve evidence, restrict content, or process a counter-notice as permitted by law. Knowingly false or malicious reports may create liability.
12Disclaimers and limitation of liability
We use reasonable skill and care, but internet services, software, and generative AI involve inherent uncertainty. To the extent permitted by law, the Service is provided “as is” and “as available,” without a guarantee of uninterrupted operation, absolute security, error-free content, or fitness for a particular purpose.
You should back up important inputs and outputs and apply independent professional judgment. No limitation in these Terms applies to liability that cannot lawfully be excluded, including mandatory consumer and personal-information rights or harm caused by intentional misconduct or gross negligence where exclusion is prohibited.
13Termination and account deletion
You may stop using the Service and ask support to delete your account. Resolve pending orders and disputes and export anything you need first. After identity verification, we will delete or anonymize personal information as described in the Privacy Policy, except records that must be retained for transactions, disputes, security, or law.
Paid-content access ends when membership expires. Termination does not affect payment, confidentiality, intellectual-property, infringement, liability, or dispute provisions that by their nature survive.
14Updates and notices
We may update these Terms for legal, product, security, or business reasons and will publish the date on this page. For a material change affecting core membership rights, personal-information handling, or dispute terms, we will provide reasonable notice through the site, email, or another appropriate channel. Continued use after the effective date constitutes acceptance where permitted; otherwise, you may stop using the Service and exercise rights available under law.
15Governing law and disputes
These Terms are governed by the laws of the People’s Republic of China, without excluding mandatory protections available to you under applicable law. Please contact us first so we can attempt a good-faith resolution. If no resolution is reached, either party may bring a claim before a court with lawful jurisdiction. Consumers retain any mandatory right to complain to a regulator or use another legally available forum.
